Ables Mini & RV Storage Auction Terms

ABLES MINI & RV STORAGE AUCTION RULES AND BIDDER AGREEMENT 1. Notice. Auction is being conducted due to tenant(s) being in default pursuant to Ables Mini & RV Storage statute. Spaces are in the same condition as left by the tenants. Delinquent units were inventoried, photographed and sealed, and have not been accessed since. Inventory was taken only visually by standing outside unit and looking in. Each unit to be auctioned will be sold as one unit. Items within a unit will not be sold individually. 2. Payment. All payments must be made in cash, cashier's check, or money order at the conclusion of the sale. If payments are not made in full within 48 hours after the conclusion of the sale, the facility in its sole discretion may sell the items to the next highest bidder at the last bid that bidder made, or the facility may sell the goods to any other person at the second highest bidder's bid price. All items are sold "as-is" with no representations or warranties. 3. Removal of items; deposit. All items must be removed within 48 hours after the conclusion of the sale. A cash deposit of $100.00 is required, refundable only after payment in full is received, unit is cleaned, lock and key are returned, and all other conditions of this bidder agreement satisfied. 4. Abandonment. Any items not removed within 48 hours after the conclusion of the sale will be deemed abandoned, will no longer be the property of the high bidder and may be discarded, donated, or sold with all proceeds going to the facility owner, and any deposit will be retained by the facility owner. 5. Bidder registration. All bidders must register a signed bidder agreement with the facility prior to bidding. If the high bidder has not registered such an agreement, in the facility's option after the sale the high bidder may register such an agreement, or the facility may sell the property to the second highest bidder at the highest bid such bidder made, or the facility may sell the items to any other person at the second highest bidder's price. The facility owner or agents are eligible to bid without registration. 6. Inspection. The extent to which contents may be inspected prior to bidding is as follows: Inspection may be only done by viewing photos as presented on www.StorageAuctions.com. 7. Tenant right of redemption. All sales are subject to the right of the tenant of the unit to redeem the property any time prior to the gavel falling at the auction sale. 8. Vehicles, trailers, boats and outboard motors. All sales of these items are subject to the rights of owners to redeem the property immediately prior to bidder payment in full and the sale is finalized. The facility makes no representations as to any ability of purchaser to acquire legal title to any such item purchased at the auction sale. Unless the newspaper notice advertising the sale contains notice of a vehicle, trailer, boat or outboard motor in the unit, any such item found in the unit is deemed NOT included in the sale and does not transfer, and must remain in the unit after the sale. 9. Beer, liquor, wine, food, drugs, cosmetics, medical devices, LP- gas containers, and illegal firearms. Any such item found in the unit is deemed NOT included in the sale and does not transfer and must remain in the unit after the sale. Also, under Texas Law (Texas Penal Code Section 46.05) it is unlawful to sell explosive weapons, knuckles (like brass knuckles), armor-piercing ammunition, a chemical-dispensing device, a tire- deflation device or a zip gun. 10. Securing unit after auction. The high bidder must immediately put his lock on the unit. The facility reserves the right to overlock the unit until payment is received. FACILITY IS NOT RESPONSIBLE FOR ITEMS TAKEN FROM THE UNIT AFTER A SALE. 11. Cleaning out unit. THERE IS NO DUMPSTER AVAILABLE ON THE PROPERTY. All units must be left "broom" clean with all items removed, including trash and debris (subject to paragraph 8 and 9 above) no later than the deadline stated above. All deposit amounts shall be retained if the unit is not left in this state. Failure of buyer to abide by this or any other sale term will result in denial of future bidding rights. Upon purchase the buyer becomes the owner of all the unit contents; it is the buyer's legal duty to properly dispose of all items warranting disposal, including any records containing sensitive personal information. 12. Rejection of bids/withdrawal of property. This facility reserves the right to place a minimum bid on any auction item or unit or reject any bid. All sales are subject to the right of the facility to pull all or part of the property from the sale of the item, batch, or unit for any reason. 13. Sales Tax. Sales Tax will be collected on the sale price unless no tax is due (such as in the sale of a vehicle or boat, or when the buyer provides a lawful exemption or resale certificate on state comptroller forms.). 14. Personal Items - please return. All buyers are requested to contact the facility and return any items that may later be found which may be of a personal nature (such as scrapbooks, pictures, marriage certificates, etc.). 15. In exchange for being allowed to view and bid at this auction, the winning bidder, to the maximum extent permitted by law, releases any auctioneer, www.StorageAuctions.com, the property owner, its managers, agents, employees, officers, shareholders and directors from any and all claims, causes of action or damages of any type, arising in any way out of the use or entry onto the property or the auction.

Notice to Bidders

Lien laws must always be followed. The Storage Facility (Ables Mini & RV Storage) reserves the right to cancel or postpone auction in its sole discretion, including for (but not limited to) compliance with applicable lien and other laws and regulations.

All bids on the site are in $10 increments.

There is a non-refundable auction fee for purposes of the staff, paperwork and other logistical expenses to undertake the auction equal to the greater of (i) $10 or (ii) 15% of the unit sale price at auction.

Upon winning an auction you will be automatically charged a down payment of 10% of the unit sales price as a deposit that will be applied toward payment of the unit sales price.

Once the initial payment is collected you will receive an invoice for the remaining balance to be paid directly to the facility. You must have an invoice in order to access the unit.

Buyers must follow the facility’s auction terms. Auction terms are not created by StorageAuctions.com.

StorageAuctions.com does not allow last second bids to win. Bidding in the last two minutes will reset the time clock to 2 minutes, then an additional bid(s) will reset the 2-minute timer.

All sales are final and considered “as is.” Bids are considered a contractual agreement that must be fulfilled.

Units must be completely cleaned out and all trash must be removed from premises. No dumpsters privileges unless location specified.

Failure to fully completely clean out the unit will result in penalties.
