Simanek Storage Auction Terms
VERY IMPORTANT - READ BEFORE YOU BID Once the auction has ended it is the responsibility of the winning bidder to contact Simanek Storage during business hours Monday thru Saturday 9:00 A.M. to 6:00 P.M., CST at 402-721-3325 to schedule an arrival time to make payment in CASH (ONLY) and claim the contents of the purchased unit during business hours. Buyer must provide a PRINTED INVOICE received from Storage Auctions, pay invoice & deposit prior to gaining access to unit, and be willing to sign a bill of sale upon payment. IMPORTANT: The person claiming the unit must match the invoice winner and provide valid Photo ID. No one under the age of 18 is permitted on the property without an accompanying adult. Buyer is required to pay a $100.00 CASH DEPOSIT. Buyer must provide their own lock to secure the unit. All sales are AS IS condition and for the entire contents of the unit. Please call 402-721-3325 to advise the manager once you have completely emptied the unit. The manager will inspect that the unit is clean and then refund the deposit. 72 hour clean out from the time sale ends. All items in the unit shall be removed from the unit and the exterior of the unit, the unit shall be broom swept (not out of the doorway) bring a dust pan to clean up floor. No items or garbage shall be left at the facility. If Seller in no contacted, winning bidder forfeits the unit and it becomes the property of Simanek Storage. No time extensions without approval and payment for extended time. If Buyer does not remove contents by the end of 72 hours and has not contacted the site manager to make arrangements to pay of additional time, the Buyer will forfeit the contents. In addition, the Buyer will be reported to Storage Auctions, and no deposit refund or refund for payment of the unit will be returned to the Buyer. Damages that are caused by the Buyer or Buyers associates while on property is the Buyer's responsibility. Buyer is responsible for the actual repair or replacement cost. Simanek Storage is not liable for any injury or damages while the Buyer and Buyers associates are claiming the winning unit. Sellers reserve the right to bid, reject any or all bids, and cancel the sale, due to if bids are, in the discretion of Seller, unreasonable. Seller reserves the right to deem any bid unacceptable. A sale is not deemed completed until all money due is paid by the Buyer of the auction and received by the Seller. A buyers remedy for a cancelled sale is limited to the return of the money paid for the unit at auction. To the best of the Sellers belief, none of the property in the unit is subject to a lien. Vehicles are not sold as part of the auction. Anything unseen, or unknown, or discovered in the unit with a VIN# are not part of the auction. No title is obtained or will be turned over to the winning Buyer. Anything that is sold is considered as PARTS. Any dangerous items found in the storage unit, such as but not limited to: firearms, illegal or prescription substances, toxic materials, explosives must be turned over to local law enforcement. Buyer can claim if firearms legally allowed from local law enforcement at their discretion. Simanek Storage (Owners) is not liable for any dangerous or illegal contents removed from the storage space by Buyer. No sales are to take place on property. Anything being sold needs to be viewed and process off sit. No online listings may be made with Sellers property name, address, phone number, images or likeness. Please conduct all business pertaining to the purchased goods off site. No dumpster privileges, smoking is prohibited in the unit, no pets allowed at facility and please be respectful to the property, managers, tenants and do not block driveways. Thank you
Notice to Bidders
Lien laws must always be followed. The Storage Facility (Simanek Storage) reserves the right to cancel or postpone auction in its sole discretion, including for (but not limited to) compliance with applicable lien and other laws and regulations.
All bids on the site are in $10 increments.
There is a non-refundable auction fee for purposes of the staff, paperwork and other logistical expenses to undertake the auction equal to the greater of (i) $10 or (ii) 15% of the unit sale price at auction.
Upon winning an auction you will be automatically charged a down payment of 10% of the unit sales price as a deposit that will be applied toward payment of the unit sales price.
Once the initial payment is collected you will receive an invoice for the remaining balance to be paid directly to the facility. You must have an invoice in order to access the unit.
Buyers must follow the facility’s auction terms. Auction terms are not created by StorageAuctions.com.
StorageAuctions.com does not allow last second bids to win. Bidding in the last two minutes will reset the time clock to 2 minutes, then an additional bid(s) will reset the 2-minute timer.
All sales are final and considered “as is.” Bids are considered a contractual agreement that must be fulfilled.
Units must be completely cleaned out and all trash must be removed from premises. No dumpsters privileges unless location specified.
Failure to fully completely clean out the unit will result in penalties.
