Midlothian Spare Room Auction Terms
Payment. All payments must be made in cash at the facility at the conclusion of the sale. If payments are not made within 24 hours after the conclusion of the sale, the facility in its sole discretion may sell the items to the second highest bidder at the last bid that bidder made, or the facility may sell the goods to any other person at the second highest bidders bid price. All items are sold AS IS with no representations of warranties. Removal of items; deposit. All items must be removed within 72 hours after auction ends. A cash deposit of seventy five dollars is required, refundable only after payment in full is received and all other conditions of this bidder agreement satisfied. Abandonment. Any items not removed within 72 hours after the end of the auction will be deemed abandoned, will no longer be the property of the high bidder and may be discarded, donated, or sold with all proceeds going to the facility owner, and any deposit will be retained by the facility owner. Inspection. Prior to bidding, please inspect all pictures posted within the StorageAuctions.com listing. The pictures represent the current state of the unit and no items will be moved or removed. Tenant right of redemption. All sales are subject to the right of the tenant of the unit to redeem the property any time prior to the gavel falling at the auction sale. Securing unit after auction. The high bidder must immediately put his lock on the unit when arriving to pay. The facility reserves the right to overlock the unit until payment is received. FACILITY IS NOT RESPONSIBLE FOR ITEMS TAKEN FROM THE UNIT AFTER A SALE AND FACILITY LOCK REMOVED. Cleaning out unit. All units must be left broom clean with all items removed no later than the deadline stated above. All deposit amounts shall be retained if the unit is not left in this state. The dumpster on the property may not be used by the buyers. Failure to abide by this or any other sale term will result in denial of future bidding rights. Upon Purchase the buyer becomes the owner of all of the unit contents and it is the buyers legal duty to properly dispose of all items warranting disposal, including any records containing sensitive personal information. Rejection of bids or withdrawal of property. This facility reserves the right to place a minimum bid on any auction item, unit or reject any bid. All sales are subject to the right of the facility to pull all or part of the property from the sale of the item, batch, or unit for any reason. Sales Tax. Sales tax will be collected on the sale price unless no tax is due, such as in the sale of a vehicle or boat, or when the buyer provides a lawful exemption or resale certificate on state comptroller forms. Personal items. All buyers are requested to contact the facility and return any items that may later be found which may be of personal nature such a scrapbooks, pictures, marriage certificates, etc. In exchange for being allowed to bid at this auction, the undersigned, to the maximum extent permitted by law, releases any auctioneer, the property owner, its manager, agents, employees, officers, shareholders and directors from any and all claims, causes of action or damages of any type arising in any way out of the use or entry onto the property.
Notice to Bidders
Lien laws must always be followed. The Storage Facility (Midlothian Spare Room) reserves the right to cancel or postpone auction in its sole discretion, including for (but not limited to) compliance with applicable lien and other laws and regulations.
All bids on the site are in $10 increments.
There is a non-refundable auction fee for purposes of the staff, paperwork and other logistical expenses to undertake the auction equal to the greater of (i) $10 or (ii) 15% of the unit sale price at auction.
Upon winning an auction you will be automatically charged a down payment of 10% of the unit sales price as a deposit that will be applied toward payment of the unit sales price.
Once the initial payment is collected you will receive an invoice for the remaining balance to be paid directly to the facility. You must have an invoice in order to access the unit.
Buyers must follow the facility’s auction terms. Auction terms are not created by StorageAuctions.com.
StorageAuctions.com does not allow last second bids to win. Bidding in the last two minutes will reset the time clock to 2 minutes, then an additional bid(s) will reset the 2-minute timer.
All sales are final and considered “as is.” Bids are considered a contractual agreement that must be fulfilled.
Units must be completely cleaned out and all trash must be removed from premises. No dumpsters privileges unless location specified.
Failure to fully completely clean out the unit will result in penalties.
