Hinds & Hinds Storage-Downtown Auction Terms
1. This public sale is being conducted pursuant to New Mexico Self-Service Storage Facilities Act for Occupants who are in default under their Rental Agreement. 2. To the best of Owners belief, none of the property in the Storage Space is subject to a lien superior to the Self-Storage Owners unless announced at the commencement of each Storage Spaces auction. 3. The decision as to the winner of each sale, as declared by the person conducting the sale, is final and binding on each sale. 4. Each of the Storage Spaces were opened before todays sale as required by statute, the Storage Space has been inventoried and overlocked with our lock and then sealed. The personal property in the Storage Space has not been touched and is still exactly as the Occupant placed them in the Storage Space. When the Storage Space was inventoried, the inventory may have been taken by standing outside the Storage Space and looking in. No goods were handled by the facility. 5. All items purchased are as is, where is. facility does not warranty or guarantee any item purchased. 6. Buyer agrees not to rely on the inventory as a statement by Owner/Operator of the contents of the Storage Space or the condition or quality of the property in the Storage Space. 7. All purchased items should be inspected prior to leaving the premises, especially items of furniture. Customers have been known to store illegal substances, so please check each item carefully. Facility is not liable for any illegal contents removed from the Storage Space by Purchaser. 8. All payments must be made in cash or credit card prior to clearing the Storage Space. 9. The sale is final upon the auctioneers conducting the sale, declaration of the word sold and the bidder number will be identified. 10. The Storage Space must be fully and finally vacated within 72hrs or the goods left will be deemed abandoned and disposed of by Owner in any reasonable manner and Owner/Operator will not be liable to any bidder for disposal of the abandoned property. Storage Space must be left broom clean. There is a dumpster on the property where use is prohibited without the first filling out a Dumpster Use Addendum in the office.(Limited Availability and only at select locations 11. We will be selling Storage Spaces in their entirety no lots. There will be a call for an opening bid and the bidding will start from there until bidding appears to be concluded. 12. A reserve may be in place for each individual Storage Space which will be announced prior to the opening of the bids for that particular Storage Space. 13. No sale premium will be added to todays sale prices. 14. Sealed bids have not been made on the Storage Spaces. 15. Items of a personal nature found in the purchased Storage Space or Storage Spaces, such as wedding licenses, photographs, birth certificates, tax records, etc., are excluded from the sale. Buyer agrees to box or bag such items in a box or bag provided by the self storage facility with the Storage Space number attached and turn said items in to the office. 16. You are not permitted to touch or move any of the items in the Storage Space until purchased by you and the sale is declared to be closed. 17. Owner reserves the right to bid on any and all Storage Spaces. 18. Owner reserves the right to end the sale at any time until the Storage Space is sold. 19. Owner or facility manager may refuse to admit any bidder onto facility property at Owners sole discretion. Agents, family members, or representatives of any person whose Storage Space is being auctioned may be prohibited from participating in any aspect of the sale at Owners sole discretion. 20. As a visitor to our facility, please be advised that there are certain hazards at a Self-Storage facility, including but not limited to, uneven pavement, storm grates, and vehicles passing through the facility. As a result, in exchange for Owners agreement to admit you to the Self-Storage facility today, you hereby agree to release and hold harmless Owner, Facility Manager and their respective owners, shareholders, partners, members, officers, directors, employees, agents, managers, representatives, successors, heirs, and assigns, from any and all liability for any injury you may suffer at the Self-Storage facility today or for any loss you may suffer while in attendance at this public sale. 21. You agree to release and hold harmless, Owner, Facility Manager and their respective Owners, shareholders, partners, members, officers, directors, employees, agents, managers, representatives, successors, heirs, and assigns, from any and all liability for any loss you may suffer to any personal property while at the Facility. 22. You further agree to indemnify the above-named released parties from any liability incurred as a result of your actions or activity at facility today. 23. The parties acknowledge the validity and sufficiency of the consideration provided in advance of the bidder entering the facility today as good, valuable and sufficient consideration for the purposes of executing this release. 24. No One Under the age of eighteen 18 admitted. 25. I have read the above-listed Auction Rules and agree to be fully and finally bound by all rules, regulations and releases contained in this information.
Notice to Bidders
Lien laws must always be followed. The Storage Facility (Hinds & Hinds Storage-Downtown) reserves the right to cancel or postpone auction in its sole discretion, including for (but not limited to) compliance with applicable lien and other laws and regulations.
All bids on the site are in $10 increments.
There is a non-refundable auction fee for purposes of the staff, paperwork and other logistical expenses to undertake the auction equal to the greater of (i) $10 or (ii) 15% of the unit sale price at auction.
Upon winning an auction you will be automatically charged a down payment of 10% of the unit sales price as a deposit that will be applied toward payment of the unit sales price.
Once the initial payment is collected you will receive an invoice for the remaining balance to be paid directly to the facility. You must have an invoice in order to access the unit.
Buyers must follow the facility’s auction terms. Auction terms are not created by StorageAuctions.com.
StorageAuctions.com does not allow last second bids to win. Bidding in the last two minutes will reset the time clock to 2 minutes, then an additional bid(s) will reset the 2-minute timer.
All sales are final and considered “as is.” Bids are considered a contractual agreement that must be fulfilled.
Units must be completely cleaned out and all trash must be removed from premises. No dumpsters privileges unless location specified.
Failure to fully completely clean out the unit will result in penalties.
