PLEASE BE ADVISED THAT you are currently in default on the payment of your rental fees and other charges for the above-referenced Storage Unit. As a result, the owner of the storage facility, Titan Storage, Inc, has placed an “overlock” on the Storage Unit. Any attempt to remove the "overlock" on the Storage Unit without Titan Storage, Inc express permission constitutes a criminal offense. You are prohibited from entering the Storage Unit and may not access any of its contents unless and until you comply with the terms of this Notice, and additional charges shall continue to accrue and become due until the amount you owe is paid in full. Please be advised that Titan Storage, Inc has a lien on the contents of the Storage Unit pursuant to Mont. Code Ann. § 70-6-605(1). Titan Storage, Inc lien shall not be lost if you, or anyone else, forcibly or fraudulently remove the contents of the Storage Unit from Titan Storage, Inc premises.
NOTICE IS HEREBY GIVEN THAT you have thirty (30) days from the date of this Notice to pay the Past Due Amount set forth above and to claim the contents of the Storage Unit. If the entire Past Due Amount is not paid within thirty (30) days of the date of this Notice, the contents of the Storage Unit will be sold at public auction or otherwise disposed of in accordance with Mont. Code Ann. § 70-6-607. The public auction will be held at 10:00AM on September 7th, 2023, at www.StorageAuctions.com. The proceeds of the public auction will first be applied to the costs of the sale and then to the unpaid rental fees and charges, and the excess proceeds, if any, will be paid to you. If you cannot be located, however, then the excess proceeds, if any, will escheat to the State of Montana as provided in Title 72, chapter 14 of Montana Code Annotated. All sales at the public auction vest title to the property sold in the purchaser of the property. Please note that this Notice fully satisfies the notice requirements of Mont. Code.
